This site is operated in part by Bonneville, who owns and maintains the services (the “Service”) offered on this site. End User understands and agrees that the Service is provided to him/her exclusively under this End User Terms of Service. By completing the registration process, End User is stating that he/she has read and understands the End User Terms of Service, and that he/she agrees to be bound by them. Bonneville may modify this End User agreement at any time, and may terminate End User’s use of the Service or otherwise revise any or all aspects of the Service in its sole discretion and without prior notice. End User’s continued use of the Service now, or following the posting of notice of any changes in this End User Agreement, will constitute a binding acceptance by End User of such rules, changes or modifications. End User represents that he/she is at least 13 years of age and, if acting on behalf of a group or organization, has the authority to do so. Any minor using the system shall do so only with the consent of a supervising parent or guardian who shall execute an End User Agreement on behalf of such minor. End User is responsible for all use of the Service under End User’s password. End User acknowledges that he/she is aware that areas accessible on or through the Service may contain material that is unsuitable for minors (persons under 18 years of age). End User agrees that he/she is entirely responsible for all uses of his/her account, whether or not authorized by End User. End User agrees to notify Bonneville immediately of any unauthorized use of his/her account. End User agrees to ensure that any content or information he/she provides will at all times be accurate, complete and not misleading. End User agrees not to place on this site any content that violates, plagiarizes or infringes upon the rights of others, including copyright, trademark, the right of privacy or the right of publicity, or that would be abusive, profane, obscene, indecent, threatening, defaming, slanderous, libelous, offensive, or otherwise illegal. End User agrees not to solicit the performance of any activity that is prohibited by law. Certain of the names, logos, and other materials displayed in the Service constitute trademarks or intellectual property of Bonneville or other entities. End User is not authorized to use any such marks. Ownership of all such trademarks and other intellectual property remains with Bonneville or those other entities. No permission is granted to hyperlink other Internet sites with any page in this site. End User agrees not to “frame” or “mirror” any of the contents or pages contained on or accessible from this site on any other server or Internet-based device without the advance written authorization of Bonneville, as applicable. This authorization terminates automatically, without notice to the End User, if he/she breaches any of the Terms of Service.

Disclaimer of Warranty; Limitation of Liability

END USER EXPRESSLY AGREES THAT USE OF THE SERVICE IS AT END USER’S SOLE RISK. NEITHER BONNEVILLE NOR ANY OF ITS INFORMATION OR CONTENT PROVIDERS, SERVICE PROVIDERS, LICENSORS, EMPLOYEES, OR AGENTS WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DOES BONNEVILLE, NOR ANY OF ITS INFORMATION OR CONTENT PROVIDERS, SERVICE PROVIDERS, LICENSORS, EMPLOYEES OR AGENTS MAKE ANY WARRANTY AS TO THE RESULTS TO BE OBTAINED FROM USE OF THE SERVICE. THE SERVICE IS DISTRIBUTED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR OTHERWISE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION, OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT. NEITHER BONNEVILLE NOR ANY OF ITS INFORMATION OR CONTENT PROVIDERS, SERVICE PROVIDERS, LICENSORS, EMPLOYEES OR AGENTS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF (A) DAMAGES RESULTING FROM ANY ACCESSING, ALTERING, OR DESTROYING OF DATA; (B) DAMAGES FROM THE INACCURACY OF THE SOFTWARE EITHER NOW OR IN THE FUTURE; (C) DAMAGES FROM LOSS OF BUSINESS, PROFITS, OR BUSINESS OPPORTUNITIES; (D) DAMAGES FROM THE INTRODUCTION OF COMPUTER VIRUSES; OR (E) LOSSES FROM INTERRUPTION, TERMINATION, OR FAILED OPERATION OF THE INTERNET, PRIVATE INTRANET OR OF THIRD PARTY TELECOMMUNICATION SERVICES. To the maximum extent permitted by applicable law, in no event will Bonneville, nor any person or entity involved in creating, producing or distributing the Service or the content included therein, be liable to End User or any third party in contract, in tort (including for its own negligence) or under any other legal theory (including strict liability) for any damages, including, without limitation, direct, indirect, extraordinary, exemplary, incidental, special, punitive, consequential or similar damages, including, without limitation, business interruption, loss of data, lost profits or revenues, loss of use or similar economic loss, arising out of the use of or inability to use the Service. End User hereby acknowledges that the provisions of this section shall apply to all use of and content on the Service. End User acknowledges that the content on the Service, by its nature, may involve a level of risk, including, without limitation, personal injury, property damage or other dangers. In no event shall Bonneville’s total liability to End User for all damages, losses and causes of action whether in contract, tort (including its own negligence) or under any other legal theory (including strict liability) exceed the amount paid by End User, if any, for accessing the Service. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, inaccuracy, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of the Service and content therein, under any legal theory or cause of action.

Indemnification

End User agrees to indemnify, defend and hold harmless Bonneville, its affiliates, licensors, officers, directors, employees, consultants, licensees and agents from and against any and all claims, demands, liability, damages and/or costs (including, but not limited to, investigation and attorneys’ fees) arising from End User’s use or any user of End User’s account of the Service or content therein, their violation of the Terms of Service, or their infringement, or infringement by any other user of their account, of any intellectual property or other right of any person or entity.

Miscellaneous

The Terms of Service will inure to the benefit of Bonneville’s successors and assigns. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by Bonneville. If any provision of these Terms of Service is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties, with all other provisions remaining in full force and effect. The failure of Bonneville to enforce any right or provision in these Terms of Service shall not constitute a waiver of such right or provision unless acknowledged and agreed to by Bonneville in writing. These Terms of Service constitute the entire agreement between End User and Bonneville with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding this subject matter. Bonneville may revise these Terms of Service at any time without notice by updating this posting, and End User agrees that their continued use of the Service after such revisions have been posted constitutes their acceptance of such revised Terms of Service. Neither party may assign or transfer this Agreement to any other person or entity without the prior written consent of the other party, (which consent shall not be unreasonably withheld), provided however that Bonneville may assign the Agreement to another entity: (i) owning a majority of its outstanding stock; (ii) into which it merges, or (iii) which acquires all or substantially all of its assets. The provisions of this Terms of Service are for the benefit of Bonneville and its contractors, information providers, service providers, licensors, employees, licensees and agents; and each shall have the right to assert and enforce such provisions directly on its own behalf. Any acknowledgment of an e-mail or other communication from End User that is in any way inconsistent with, or adds to, the provisions of these Terms of Service is null and void. Neither the course of conduct between parties nor trade practice shall act to modify the provisions of these Terms of Service. Bonneville may authorize or allow its contractors and other third parties to provide to Bonneville and/or to End User services necessary or related to making the Service available and to perform obligations and exercise rights of Bonneville under these Terms of Service. Any obligations or duties which by their nature extend beyond the termination of these Terms of Service shall survive any expiration or termination of these Terms of Service. Bonneville and/or third parties may from time to time send e-mail messages to End User containing advertisements, promotions and other such information. Bonneville makes no representation or warranty with respect to the content of such email messages or any goods or services which may be obtained from such third parties, and End User agrees that neither Bonneville nor such third party shall have any liability with respect thereto. Recognizing the above, End User chooses to voluntarily enter this space and to use the Service and to not hold Bonneville responsible for any action or inaction on either of their parts. End User chooses to use the service and to abide by the terms and conditions set forth here.

Therefore, you should review the Policy from time to time. Your continued use of the Site constitutes your acceptance of the revised Policy. If you do not accept all of the terms, conditions, and notices set forth in the Policy, you must exit the Site immediately.

Information Type Examples
Identifiers Your name, username, postal address, email address, IP address, phone MAC address, and phone number
Protected Record Information Your social security number to verify your eligibility to participate in a contest
Characteristics of Protected Classifications Your date of birth and gender
Internet or Electronic Network Activity Information Information about the web sites you visited before and after you visit the Site, and information about your interaction with our Services

We collect this information in the following ways.

When You Provide It to Us. We collect information about you that you voluntarily provide while on the Site or by engaging with our Services, or when you contact us. Certain features available within the Site will require you to submit information about yourself as a condition of participation. For instance, when you participate in contests, we may require you to provide us with your social security number and/or other information to verify your eligibility to participate in such contests.

Please note that although some of the features on our Site are offered by us, others may be offered by third parties through the Site. For example, you may be required to submit personal information to receive news updates by email from a third-party news source. When you choose to submit personal information to a third party in connection with your use of the Site, the third party’s privacy policy, rather than this Policy, will control the use and disclosure of your personal information.

When You Visit the Site and Use Our Services. We, or third parties that offer features through the Site on our behalf, may collect information using “cookies,” “web beacons,” “Flash cookies,” or by other electronic means.

  • Cookies. A cookie is a small amount of data sent to your browser from a web server and stored on your computer’s hard drive, where it can be used to identify your computer. Cookies can be used to measure web site usage, improve navigation around web sites, and personalize a returning visitor’s experience on the website. In most cases, you can set your browser to turn off cookies or to notify you before you receive one so that you can decide whether to accept it or not. Because cookies allow you to take advantage of some of the features on the Site, we recommend that you leave them turned on. If you block or reject our cookies, some of the features on the Site may not work for you. You can refer to the instructions for your browser to learn more about these functions.
  • Web Beacons. We, or our third-party service providers, advertisers, and partners, also may use “web beacons” or similar technologies. Web beacons are small strings of code placed on a web page to collect data about how visitors use the Site. For example, web beacons may be used to count the number of users who visit the Site or to deliver a cookie to the browser of a visitor to the Site. If you set your browser to turn off cookies, web beacons and similar technologies will detect your visits to the Site, but they will not associate your activity on the Site with information that otherwise would be stored in cookies. We do not control tracking technologies used by third parties on the Site.
  • Flash Cookies. The Site uses locally stored objects, also called “Flash cookies,” when it uses Adobe Flash Player (“Flash”) to provide special content such as video streaming, video on demand, video clips, or animation. Flash, and similar applications, use Flash cookies to remember visitors’ Site settings, preferences and usages. Flash cookies are managed directly through Adobe’s website, rather than through your web browser.

For more information about cookies and other technologies, and to learn more about behavioral advertising or to opt out of this type of advertising for some companies, you can visit http://www.networkadvertising.org or http://networkadvertising.org/optout_nonppii.asp. When using a mobile application, you may receive tailored in-application advertisements. Each operating system provides its own instructions on how to prevent the delivery of tailored in-application advertisements. You may review the instructions and/or the privacy settings for your operating system to find out how to opt out of tailored in-application advertisements.

Certain web browsers may allow you to enable a “do not track” option that sends signals to the websites you visit indicating that you do not want your online activities tracked. This is different than blocking cookies as browsers with the “do not track” option selected may still accept cookies. Right now, there is no industry standard for how companies should respond to “do not track” signals, and therefore we do not respond to “do not track” signals at this time. If we do so in the future, we will modify this Policy accordingly. More information about “do not track” is available at www.allaboutdnt.org. We do not authorize the collection of your personal information for third party use through advertising technologies without you providing consent directly to such third parties.

Additionally, the Site may use the re-marketing services of third parties, including Google AdWords, to advertise on third party websites to previous visitors to our Site. This remarketing will display relevant ads tailored to you based on what parts of the Site you viewed by placing a cookie on your machine. Any data collected will be used in accordance with our own privacy policy and the Third Parties’ privacy policy. You can set your preferences for how Google advertises to you using www.google.com/settings/ads/onweb/ or opting out as explained above.

When You Engage with Us on Social Media. You also may view or engage with our Site and our Services through third-party social networking sites or social media plug-ins and applications, including when we conduct contests using such third-party sites. When you engage with the Site and our Services through such third-party sites, plug-ins or applications, we may have access to certain information from your social media profile, such as your name, photo, gender, birthday, location, videos and other content you create, your list of friends, etc.

  • Enforce the terms of this Policy.

In the event that we are considering a sale of our business, in its entirety or a component thereof, or substantially all or a portion of its assets are acquired, personal information may be one of the transferred assets, and may therefore be used by a third-party acquirer in accordance with this Policy. Such use by a third party may include review of personal information, using such information to contact you either before or after such a transfer or sale, or for other purposes.

Information You Elect to Share. You may elect to share information through the Services by, for instance, posting comments on comment boards or listing classified advertisements. Some of your activity on the Site, including content you have posted, is public by default.

Information Disclosed to Vendors, Partners, Service Providers, and Others for Business Purposes. We contract with vendors to provide services related to the Site and may share information with such vendors in order to provide products or services to you or to help maintain the Site.

Specifically, California law provides residents with the right to request that we disclose what personal information we collect, use, and disclose about them. If you are a California resident, California law permits you to make the following requests of Bonneville International Corporation regarding the personal information we have collected:
